Appendix 1 Terms and Conditions and Artwork CUSTOMER Terms and Conditions
  1. The promoter is Lucky Star (“The Promoter”).
  2. The promotion is open to all South African residents in possession of a valid identity document, except any director, member, partner, employee, agent or consultant of the Promoter, J Walther Thompson, the marketing service providers or any person who directly or indirectly controls or is controlled by these entities, including their spouses, life partners, business partners or immediate family members.
  3. All information relating to this Competition and published on a website Lucky Star (“Lucky Star or “The Promoter”) (www.luckystar.co.za) on any promotional or advertising material, forms part of the terms and conditions of this Competition (“Rules”). By entering the Competition and/or accepting any prize, all entrants and winners agree to be bound by the terms and conditions below (“Rules”).
  4. This promotional competition is open from 12th February 2017 and ends at midnight on the 31st March 2016. Any entries received after the closing date will not be considered. The promotion is open to all South African Residents who are 18 years and older.
  5. To enter and stand a chance to win one of the prizes, customers are required to (a_ purchase any amount of Lucky Star Pilchards ; (b)Fill in the entry form and place in the entry box.
  6. Prizes: Prizes will be determined by the Store Owner, there will be two draws that takes place one in March and one in April, which means there will be two prizes up for grabs.
  7. All winners will be required to provide proof of their purchase, their names, ID numbers & contact details and may be required to sign acknowledgement of receipt of prize.
  8. The winners of the monthly prize draw will be randomly selected by the Store Owner/Agent and winners will be notified telephonically within one week of the selection having taken place.
  9. The prize is non-transferable and may not be exchanged for cash. Any prize not taken up for any reason within 14 days of notification will be forfeited.
  10. The name of the winner, once contacted, will be published on the Lucky Star website and the prize and winners’ names may, with permission from the winner, be used for digital marketing.
  11. The Promoter shall not be responsible for any lost, damaged, delayed, incorrect or incomplete entries for any reason whatsoever.
  12. The Promoter shall not be responsible for the failure of any technical element relating to this promotion that may result in an entry not being successfully submitted.
  13. The Promoter reserves the right to disqualify any claim if fraud or cheating is suspected, including without limitation, through the manipulation of code or otherwise frequently falsifying data.
  14. No applications from agents, third parties, organised groups or applications automatically generated by computer will be accepted. No incomplete or corrupt entries will be accepted. Entries will only be accepted if they comply with all the entry instructions.
  15. If required the Promoter reserves the right to take and use images of the winner(s) for publicity purposes in any manner they deem fit, without remuneration being made payable to the winner.
  16. The Promoter shall have the right to change or terminate the promotional competition immediately and without notice, if deemed necessary in its opinion and if circumstances arise outside of their control. In the event of such change or termination, all participants agree to waive any rights that they may have in respect of this promotional competition and acknowledge that they will have no recourse against the Promoter or its agents.
  17. By participating in this promotion participants agree to receive further marketing material from the Lucky Star team. Participants will have the option to unsubscribe or opt out from receiving marketing material if they wish.
  18. Personal information collected by the promoter during the competition will not be shared with any 3rd party without participant’s permission.
  19. Neither the Promoter, its agents, its associated companies, nor any directors, officers nor employees of such, including consultants, shall be liable for any loss or damage, whether direct, indirect, and consequential or otherwise arising from any cause whatsoever, which may be suffered by the participant.
  20. By entering, a participant acknowledges that personal information about prize winners will be shared with the Promoter’s agents to the extent necessary for prizes to be delivered to prize winners.
  21. All personal information relating to the participants will be used solely in accordance with South African consumer and data protection legislation.
  22. The judges’ decision is final and no correspondence will be entered into.
Participation in the promotional competition constitutes acceptance of the promotional competition rules and participants agree to abide by the rules.      

 
Appendix 1 Terms and conditions for BLNS:Under the Lid Promotion
  1. The promoter is Lucky Star (“The Promoter”).
  2. This is a promotional competition called BLNS: Under the Lid Promotion (the “Competition”) conducted by Lucky Star Ltd (Registration Number: 1946/022718/06) of 8th Floor, Oceana House, 25 Jan Smuts Street, Foreshore, Cape Town (the “Promoter”).
  3. Except for those participants described in clause 8 below, the Competition is open to individuals who are currently residing in the Republic of Botswana, or the Kingdom of Lesotho, or the Republic of Namibia, or the Kingdom of Swaziland who have a valid identity number /valid passport / refugee documents and who are 18 years or older with a bank account.
  4. To enter the competition, and stand a chance to win their share of P200,000.00 / M100,000.00 / N$ 250,000.00 / E100,000.00, consumers are required to: 4.1 purchase one or more cans of Lucky Star Pilchards; 4.2 check under the lid to see if they have won; 4.3 using a cell phone, sms “LUCKY STAR”, to the number inside the lid of the can; 4.4 the lid of the winning Lucky Star can must be retained as proof of purchase. 4.5 the consumer will receive an sms within 24 hours to confirm receipt of their sms. 4.6 the consumer will receive a phone call within 7 business days to the cell number from which the sms was received, to verify their entry, prize and to advise how the prize can be redeemed. 4.7 SMS cost P0.00, M1.00, N$1.00 and E1.00 across all networks.
  5.  Prizes, depending on the country of residence of the entrants consist of: 5.1 Botswana – 1x P50 000, 2 x P25 000, 5 x P5 000, 150 x P500. 5.2 Lesotho – 1 x M10 000, 5 x M5 000, 130 x M500. 5.3 Namibia – 2 x N$50 000, 2 x N$25 000, 5 x N$5 000, 150 x N$ 500. 5.4 Swaziland – 1 x E10 000, 5 x E5 000, 130 x E500.
  6. Payment of the P500, M500, N$500 and E500 in the respective countries will be via Shoprite Direct sent to the winners’ cell phones; Payment will be made within 30 days.
  7. Prizes valued from P5000, M5000, N$5000, E5000 and above will be redeemable at a cheque handover ceremony to be arranged by the Promoter.
  8. The competition opens on 17 March 2017 and closes at midnight on 28 May 2017. Prizes can be claimed until 31 December 2017.
  9. Winners will be contacted via cell phone and names will be published on the Promoter’s website (www.luckystar.co.za) as well as via various radio stations and the Promotor’s social media pages as soon as winners have been identified, up to 31 December 2017.
  10. The prize shall not be awarded to a director, member, partner, employee or agent of, or consultant, or their spouse, partner or members of their immediate family, to the Promoter, CIC (Pty) Ltd Namibia, Safari Distributors (Pty) Ltd Botswana, Morena Distribution Sales and Marketing Company Limited Lesotho or Swazi Sales and Marketing Swaziland, or any other person who directly or indirectly controls or is controlled by, the Promoter, or to a supplier of goods or services in connection with the competition. The Promoter reserves the right to request a winner to depose an affidavit confirming that he/she does not fall within this category of persons and must further upon request be able to verify their identity by providing a certified copy of their identity document or valid passport.
  11. Prizes are not transferable and will only be given to the winner and not a representative
  12. If for whatever reason the winner cannot be contacted within 14 days from receiving the confirmation sms referred to in 3.5 or is disqualified in terms of clause 18 below, the prize will be forfeited to the Promoter.
  13. By entering this competition, the participant acknowledges and agrees that the Promoter, its agents and representatives are granted the right to invite the participant, which invitation the participant has the right to decline, to be present at the cheque handover ceremony to the winners, to participate in any marketing activity and use the footage and/or images of the winner in whole or part and in connection with the distribution, broadcasting and all advertising, marketing and promotions to do with the footage in relation to the Competition, without remuneration being payable to the winner(s).
  14. When a participant submits an entry and/or sends e-mails to the Promoter, that participant consents to receiving communications from the Promoter electronically and agrees that all agreements, notices, disclosures and other communications sent by the Promoter electronically satisfy any legal requirements, including but not limited, to the requirement that such communication should be “in writing”.
  15. A participant, by entering the competition, agrees and gives consent that the information provided to enter the competition may be stored and used for statistical purposes or for marketing purposes by the Promoter. Consent to use the participant’s information is not a condition for entry in the competition and the participant has the right to withdraw such consent at any time by notifying the Promoter per telephone on number 021 415 8600 or per e-mail at info@luckystar.co.za.
  16. Information collected from participants will be used by the Promoter only and will not in any way be transferred or made available to third parties except if it remains for the use by the Promoter only.
  17. A participant will have the right to request from the Promoter details of the information held of the participant and to update and/or correct any of the information provided. The Promoter can be contacted for this purpose per telephone on number 021 415 8600 or per e-mail at info@luckystar.co.za.
  18. No correspondence will be entered into and the Promoter’s decision is final and binding, subject only to the supervision and certification of the competition by an independent accountant, registered auditor, attorney or advocate and the reporting thereon through the Promoter’s internal audit reporting procedures.
  19. When entering the competition, a participant acknowledges and agrees to these terms and conditions.
  20. Should any participant or winner be found to be in contravention of any of these terms and conditions or in the opinion of the Promoters, engaged in conduct in entering the Competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill of reputation of the Promoter, the Promoter reserves the right to disqualify such a participant or winner on written notice.
  21. 20 The Promoter chooses as its domicilium citandi et executandi for all purposes under this competition, whether in respect of court process, notice or other documents or communication of whatsoever nature: 7th Floor, Oceana House, 25 Jan Smuts Street, Cape Town, 8001.
  22. When entering the competition, a participant acknowledges and agrees to these terms and conditions.
  23. The Promoter has the right to terminate the competition immediately and without notice in the event that, due to reasons beyond its control, it is impossible to continue with the competition. In the event of such termination, all participants agree to waive any rights that they may have in terms of this competition and acknowledge that they will have no recourse against the Promoter, its directors, employees and agents.
